Introduction

Welcome to Cases2CS (“Cases2CS”, “Platform”, "We"). Your use of the Platform is governed by these Terms of Service (“Terms”). By accessing and using the Platform, you agree to be legally bound by the Terms as a binding agreement between you and Cases2CS. Please review them carefully. If you do not agree to the Terms, please refrain from using the Platform or any of its content.

The Platform connects users who own virtual and digital items (“Items”) and allows them to trade or resell these Items using the Steam gaming platform, which is owned by Valve Corporation (US).

Please note that Cases2CS is not affiliated with Steam or Valve Corporation in any way. Users can exchange Items with each other or with Cases2CSt, in which case, Cases2CS will acquire ownership of the Items sold by the user in exchange for an Item in its possession.

Platform usage

Cases2CS provides you with a personal, limited license to access and use the Platform and its services, provided you agree to and comply with these Terms. This license is non-transferable, non-sublicensable, non-exclusive, and revocable. You must be at least 18 years old and a natural person to use cases2cs.com. Items can only be held by legal residents of countries where using the Platform's services is allowed. Cases2CS may reject your purchase or acquisition of Items for any reason or adjust the pricing of Items at its discretion.

Your account

Upon creating your user account, you are required to provide accurate and complete information. If there are any doubts about your identity or the accuracy of the information you provided, Cases2CS has the right to request appropriate proof of identity to establish your identity and prevent fraud. You are strictly prohibited from:

  • providing proof of identity of third parties;
  • creating an account on behalf of third parties;
  • creating multiple accounts for a single user;
  • sharing a single account among multiple users or taking any similar action.

If Cases2CS suspects any fraudulent or criminal activity, it may suspend transactions, disbursement of the credit balance, transmission of the Items or even suspend your account until the suspicion has been removed. Any attempt to disrupt or interfere with the Platform or any of its services, including manipulating the legitimate operation of the Platform, is considered a violation of Cases2CSt’s policy and may be subject to criminal and civil laws applicable in your jurisdiction.

Note that payments exceeding a certain amount may be subject to KYC protocol. When you sign in to the Platform through Steam, Cases2CS will only receive your Steam64ID, a unique identifier that can be used to receive information such as your games, items, friends, avatar, and display name from the Steam Web API.

You are solely responsible for safeguarding your login information and passwords. You must keep your login information and password (as well as your Steam Profile and Trade URL) confidential, prevent third parties from accessing your account, and monitor all activities under your account. You are also responsible for ensuring that any actions, offers, purchases, and exchanges you perform on the Platform comply with all applicable laws and regulations.

Security

Please be advised that Cases2CS employees will never send you trade offers requesting Item verification without any items included in the offer. If you receive such an offer or any similar offer or request from someone claiming to be a Cases2CS staff member through email or any other means, please report it to Cases2CS support immediately. Moreover, do not add any staff members on Steam for site support as all support and instructions will only be provided through the Platform or via email at [email protected]. Please note that Cases2CS will not be held liable for any damages resulting from any fraudulent activity conducted by a third party claiming to be a Cases2CS staff member.

Balance storage and withdrawal for users

The Cases2CS wallet does not function as a bank account or a payment instrument. Instead, it serves as a prepaid balance solely for purchasing items that are available on the Platform from time to time. In order to use the Cases2CS wallet, the following requirements must be met:

  • During registration on the Platform via Steam, a digital wallet linked to your Steam64 ID account must be created.
  • You can deposit money (in US dollars) into your digital wallet, which will show your current balance.
  • The credit in your wallet can only be used to buy items that are available for sale through the Platform.
  • Withdrawals of money from your digital wallet on the Platform are not possible.
  • We reserve the right to ban your account without explanation if we suspect or if you violate any of the Terms outlined herein.
  • You can top up your balance using our payment system. When you top up your balance, Cases2CS may choose to award your account with a certain bonus (depending on the payment method) based on the amount paid by you to the website at the time of the deposit.
  • The maximum amount that can be deposited into your Cases2CS wallet per calendar day in the U.S. (EST) is limited to the equivalent of USD 3000 when exchanging items.
  • All monetary transactions are expressed in US dollars and are gross of all applicable taxes.

Cases2CS assumes no liability for any losses incurred as a result of using your credit card or any other payment method to purchase items and/or receive credit.

Prohibited actions

By accessing and using the Website, whether or not you purchase any Products, you agree not to engage in the following activities:

  • Use the Website for any purpose other than its intended purpose;
  • Violate any laws, regulations, byelaws, these Terms, or our Privacy Policy;
  • Attempt to disrupt, disable, damage, interfere with, or overload the Website or any networks or services connected to the Website;
  • Exploit errors or bugs in the Website to gain unauthorized access;
  • Copy or modify the Website software;
  • Use any unauthorized technology or automated system to access the Website or extract content from it, including spiders, robots, screen scrapers, or offline readers;
  • Infringe on the Company's or any third party's copyright, trademark, intellectual property, or other rights;
  • Attempt to impersonate another user or person or use another user's username;
  • Use the Website fraudulently, unlawfully, or in a manner that contradicts the Company's interests or any specific rules or requirements outlined on the Website;
  • Create multiple accounts.

We reserve the right to seek legal recourse and recover damages or compensation under these Terms or as permitted by law.

Buying and Payment

When you want to purchase any of our Products, select the one you want and pay for it using your preferred payment method. All payments are processed through third-party services, and we do not collect any payment information. We receive a notification only after the payment has been completed.

You agree to comply with all applicable tax laws, including reporting and paying any taxes related to your purchase of Products through the Website.

We promise to upload a purchased Product into your Account as soon as possible, usually within 24 hours of receiving notification of your payment. After that, you may withdraw the Product by transferring it to your Steam user account.

If payment fails or is refused by the payment service provider, we have no obligation to fulfill the purchase.

Products are considered digital content that is not supplied on a tangible medium according to Directive 2011/83/EU of the European Parliament and of the Council. Therefore, you acknowledge and agree that purchasing Products means you forfeit the right of withdrawal, and Products cannot be returned as prescribed in Article 16(m) of the Directive.

If you experience any problems with a Product, please contact us as soon as possible. We offer a 24-hour guarantee for Products that contain errors when uploaded to your Account or are different from the Products you purchased.

Know Your Client (KYC)

To avoid the risks associated with any potential involvement in illegal activities, Cases2cs strictly adheres to Anti-Money Laundering and Counter-Terrorist Financing (AML/CFT) regulations. By complying with these regulations, we aim to prevent and minimize any potential risks.

In order to maintain the highest standards of safety and compliance, we may conduct thorough analysis of all suspicious user activity and transactions on our platform. The list of activities deemed suspicious is determined exclusively by Loot-CsCase and encompasses, but is not limited to, the following:

  1. attempts to conceal identity, including the use of outdated, false, or someone else's documents, as well as refusal to provide requested documents for identity verification;
  2. the use of unauthorized Payment Methods and failure to substantiate ownership;
  3. the use of multiple accounts in a manner that raises concerns;
  4. the use of vulnerabilities or bugs within the platform;
  5. instances where a third party raises claims related to a user's transaction (such as chargebacks or disputes);
  6. processing of payments over 1000 Euro or its equivalent. In this context, top-up or withdrawal payments amount is considered not as a single transaction, but as a sum of top-up or withdrawal transactions;
  7. engagement in illegal activities and violations of the Terms of Use.

In the event we detect or have reasonable grounds to suspect that your activity violates our Terms of Use, we reserve the right to take the following actions at our discretion, without prior notice:

  1. suspend or refuse a trade/transaction;
  2. blocklist UserТs Payment Method;
  3. withdraw the User's Cases2cs Balance;
  4. initiate an additional Know Your Customer (KYC) procedure;
  5. temporarily suspend or block the User's Account.

As the KYC procedure is an essential component of our compliance with Anti-Money Laundering and Counter-Terrorist Financing (AML/CFT) regulations, we may request you to complete the KYC verification process by providing us with the following documents:

  1. passport or National ID: a valid identification document that confirms your identity;
  2. utility bill or bank account extract: a document that serves as proof of your address, such as a utility bill or bank statement;
  3. source and proof of funds: documentation that demonstrates the origin and legitimacy of your funds used for transactions;
  4. any other documents required for compliance: we may request additional documents necessary to meet the AML/CFT policies and regulations in effect.

If you fail to provide us with the necessary KYC documents within 5 days after our request, we reserve the right to take certain actions, including but not limited to rejecting the investigated trade/transaction, freezing the investigated funds, or temporarily or forever suspending your account.

Please note that all documents submitted as part of the KYC procedure are subject to the Cases2cs Privacy Policy. These documents will be used solely for the purpose of verifying your identity and facilitating the provision of services in accordance with our privacy practices and applicable regulations.

Your privacy

We value your privacy and are committed to processing your personal data in a fair, transparent, and lawful manner. For more details on how we handle your personal data, please refer to our Privacy Policy.

Legal Matters and Dispute Resolution

Our commitment to lawful, fair, and transparent handling of your personal data is reflected in our Privacy Policy. These Terms, along with any agreements between you and us, are subject to the laws of the Republic of Cyprus. Any disputes or claims that arise from these agreements, including issues or complaints regarding our Website or product purchases, will be settled in the courts of the Republic of Cyprus.

We urge you to contact us with any grievances or complaints, and we will endeavor to reach an amicable resolution through negotiation.

If you believe your rights under relevant consumer protection laws have been violated, you may use the European Commission's Online Dispute Resolution platform at http://ec.europa.eu/consumers/odr/ to seek a solution. Additionally, there may be other dispute resolution platforms available in your country of residence.

We reserve the right to update, amend, or modify these Terms at any time. The latest version of the Terms will be posted on our Website, and the effective date of any changes will be indicated. By continuing to use the Website after the effective date of any updates, you indicate your acceptance of the current version of the Terms.

Limitation of Liability

Our Company, owners, affiliates, contractors, and agents are not liable to you or any third party for any direct or indirect damages, including lost profits or lost business, or any special, indirect, consequential, exemplary, or incidental damages arising from your use or access to the Website or purchase of Products.

However, this section does not limit our liability for damages caused by our own gross negligence or intentional or unlawful misconduct. Furthermore, nothing in this section is intended to limit or alter your rights as a consumer that cannot be limited or altered under applicable law.

Our total liability shall not exceed the greater of the amount you paid us in the last 12 months or EUR 200.

We do not guarantee that the Website, its content, or Products will be error-free, uninterrupted, or free of defects, or that the use of the Website will produce specific results. The Website, content, and Products are provided on an "as is" and "as available" basis.

All information provided on the Website is subject to change without notice. We do not guarantee that any files or other data you download from the Website will be free of viruses or other harmful features. We disclaim all warranties, including any warranties of accuracy, non-infringement, merchantability, and fitness for a particular purpose. We are not liable for the acts, omissions, and conduct of any third parties related to or arising from your use of the Website. You assume full responsibility for your use of the Website and purchase of Products. Your sole remedy for dissatisfaction with the Website or its content is to stop using the Website or such content.
